According to this Citizens' Guide to Federal Obscenity Laws "Federal law prohibits the distribution of obscenity through the facilities of interstate or foreign commerce. More specifically, it is a crime to use the mail to send or receive obscene materials, to import obscenity, to ship or receive obscenity by a common carrier, or to transport obscene materials across state lines for sale or distribution, including by computer...While even the mere possession of child pornography is a crime, private possession of obscenity is not, although the act of receiving obscenity could violate the statutes prohibiting use of the mails, carriers, or interactive computer services for the purpose of transporting such material"
Thats right the justice department is now warning you that you can be arrested for downloading porn or recieving it via the mail. This interpertation has never been used before to the best of my knowledge. In another section they say they are working with another branch of the justice department to track and understand peer to peer downloaded porn... guess they weren't satisfied just going after distributors, publishing companies (and in one specific case a women who wrote "erotic" stories about child molestation...thats right written word) directors,ect. Now they want to arrest users. Thats right pervs, they is going after us.
There is apparently an ongoing effort to ramp up prosecution and arrests before the current justice department gets re-ordered under the next president. The people on top think of themselves as "culture warrior". Of course I didn't have to tell you that... "This much has been categorically decided by the Court, that obscene material is unprotected by the First Amendment. Miller v. California, 413 U.S. 15, 23 (1973). Enforcement is necessary in order to protect citizens from unlawful exposure to obscene materials. The welfare of America's children and families demands the vigorous enforcement of obscenity statutes, as traffickers in illegal adult obscenity employ advancements in technology and marketing to extend their unlawful and harmful influence.
The Task Force is drawing upon its expertise to pursue innovative solutions to the threat posed by those who violate obscenity laws and is mounting a determined effort to coordinate resources at all levels of government to give people the protection the laws are intended to provide."
